Website and vehicle-rental enquiry terms for Silverbrookatelier.

1. About these terms

These terms govern use of the Silverbrookatelier website and the submission of vehicle-rental enquiries. They do not by themselves create a vehicle-rental contract. A rental becomes binding only after availability, driver eligibility, price, deposit, insurance, collection arrangements and all material conditions have been confirmed in writing by Silverbrook Atelier Ltd and accepted by the customer.

2. Website use

You may use the website for lawful personal or business enquiries. You must not interfere with security, attempt unauthorised access, submit malicious code, overload the service, scrape content in a manner that disrupts operation, impersonate another person, or use the website to facilitate fraud or unlawful activity.

We may restrict access where reasonably necessary to protect the website, users, vehicles, staff or legal rights.

3. Information and availability

Vehicle descriptions, categories, features, images and indicative service information are provided for general guidance. Images are illustrative. A specific make, model, colour, fuel type, transmission, seating configuration or accessory is not guaranteed unless expressly confirmed in the rental agreement.

Availability can change between an enquiry and final confirmation. We may offer a substantially similar vehicle where the requested vehicle becomes unavailable, subject to your acceptance and any rights provided by law.

4. Enquiries and quotations

Submitting a form is an invitation for us to assess the request; it is not an automatic booking confirmation. A quotation may be time-limited and may change if the dates, vehicle category, driver information, location, mileage, insurance option, taxes, fees or other assumptions change. Obvious pricing or description errors may be corrected before a rental is formed.

5. Driver eligibility

The principal driver and every additional driver must meet the age, licence, identity, residency, payment and insurance requirements stated during the booking process. The usual minimum rental age is 21, but higher minimum ages, maximum ages, licence-duration requirements or young-driver charges may apply to particular vehicle groups.

Drivers must provide a valid driving licence accepted for use in the United Kingdom, appropriate identity documents and any required check code or supporting permit. We may refuse or cancel a rental where information is inaccurate, documents cannot be verified, insurance conditions are not satisfied, or there is a reasonable safety, fraud or legal concern.

6. Prices, deposits and payment

The final price will identify the rental charge and any applicable tax, delivery or collection charge, optional extra, additional-driver charge, mileage allowance, young-driver charge, fuel option or other agreed fee. A security deposit or payment-card pre-authorisation may be required before vehicle release.

The named payment-card holder may be required to attend collection and present the original card. Release times for pre-authorisations are controlled partly by the relevant payment provider and bank. We are not responsible for a bank's processing delay, although we will provide reasonable information to support release where appropriate.

7. Insurance, excess and exclusions

Insurance or damage-waiver arrangements, the applicable excess and any exclusions will be explained in the rental documentation. Cover may be invalidated or reduced by an unauthorised driver, prohibited use, deliberate or reckless conduct, misfuelling, driving while impaired, failure to secure the vehicle, use outside the agreed territory, use on unsuitable roads, or breach of the rental agreement.

Customers remain responsible for charges not covered by the selected insurance or waiver, subject to applicable law and the terms supplied before rental.

8. Collection and return

The vehicle must be collected and returned at the agreed place and time. At collection, the driver should inspect the vehicle and ensure existing damage and fuel or charge level are recorded. The vehicle must be returned with all keys, documents, equipment and accessories in the condition required by the agreement, allowing for fair wear and tear.

Late return, unauthorised extension, abandonment, exceptional cleaning, missing items, new damage, charging costs or recovery costs may result in additional charges where permitted by the agreement and law.

9. Fuel, charging and mileage

The agreed fuel or electric-charge policy and mileage allowance will be stated before rental. Customers may be charged for missing fuel or charge, service costs and excess mileage according to the confirmed terms. Electric-vehicle range depends on weather, driving conditions, load, speed, charging availability and battery state; any range figure is an estimate rather than a guarantee.

10. Permitted and prohibited use

The vehicle may be used only by authorised drivers and only for lawful purposes within the agreed territory. Unless expressly approved, prohibited uses include racing, speed testing, towing, off-road use, driving instruction, carrying dangerous or illegal goods, sub-hire, ride-hailing, delivery work, use while impaired, overloading and travel outside the permitted area.

The customer must take reasonable care, comply with road laws, use the correct fuel or charging method, secure the vehicle and promptly report warning lights, defects, loss, theft, collision or damage.

11. Fines, tolls and administrative charges

The customer is responsible for parking charges, tolls, congestion charges, traffic penalties and similar liabilities arising during the rental, unless caused by our fault. Where legally permitted, we may provide hirer information to an issuing authority and charge a reasonable administrative fee disclosed in the rental agreement.

12. Breakdown, collision and incidents

Customers must follow the supplied safety and roadside-assistance instructions. In an emergency, contact the appropriate emergency service first. Any collision, theft, vandalism, tyre or glass damage, warning light or mechanical problem must be reported promptly. The driver must not admit liability, arrange unauthorised repairs or abandon the vehicle except where necessary for immediate safety.

13. Cancellation and changes

Cancellation, amendment, no-show and early-return rules will be set out in the quotation or rental confirmation. Any statutory cancellation right will apply where the law requires it. Vehicle-rental services supplied for a specific date or period may be excluded from the general consumer cancellation right applicable to some distance contracts.

We may cancel before collection if the vehicle becomes unavailable, eligibility requirements are not met, payment fails, information is materially inaccurate, or performance would be unlawful or unsafe. Where we cancel for reasons not caused by the customer, we will provide an appropriate refund of sums paid for the unavailable service.

14. Liability

Nothing in these terms excludes or limits liability where exclusion would be unlawful, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or breach of rights that cannot legally be excluded.

Subject to that restriction, we are not responsible for losses that were not reasonably foreseeable when the contract was made, losses caused by inaccurate information supplied by the customer, or business losses arising from a consumer rental. For business customers, any additional limitations will be stated in the rental agreement.

15. Personal information

Personal information is handled as described in the Privacy Policy and any additional rental privacy notice. Information may be used for eligibility checks, contract administration, fraud prevention, insurance, safety, legal compliance, claims and enforcement of the rental terms.

16. Intellectual property

The website design, text, graphics, logos and original content are owned by or licensed to Silverbrook Atelier Ltd. You may view and print reasonable extracts for personal use connected with an enquiry. You may not reproduce, sell, modify or distribute substantial website content without prior written permission, except where law allows.

17. Complaints and dispute resolution

Please send service complaints to info@silverbrookatelier.com with the rental or enquiry reference, relevant dates and the outcome requested. We will investigate and respond within a reasonable time. Data protection complaints are handled under the procedure described in the Privacy Policy.

These terms do not restrict any mandatory consumer rights or your ability to use a court or other legally available dispute-resolution route.

18. Governing law

These website terms and any non-contractual dispute arising from them are governed by the law of England and Wales. Courts with jurisdiction under applicable consumer and civil procedure rules may hear a dispute. A consumer living elsewhere in the United Kingdom retains any mandatory protections and jurisdiction rights available under the law.

19. Changes and severability

We may update these website terms for legal, security or operational reasons. The version in force when a rental is confirmed will not be replaced retrospectively except where the contract or law permits. If a provision is found unenforceable, the remaining provisions continue in effect.
